- WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- IN NO EVENT SHALL INFINITY PRO AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR LOSSES RESULTING FROM AI-GENERATED CONTENT, DATA BREACHES, OR THIRD-PARTY SERVICES
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
12Indemnification
You agree to indemnify, defend, and hold harmless Infinity Pro AI, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Your violation of applicable laws or regulations

13Service Availability & Uptime
Uptime Commitment: We strive to maintain 99.9% uptime for our Services, excluding scheduled maintenance and circumstances beyond our control.
Maintenance: We may perform scheduled maintenance with advance notice. Emergency maintenance may be performed without notice.
Service Interruptions: We are not liable for service interruptions caused by:
- Third-party service failures (internet providers, cloud infrastructure, etc.)
- Force majeure events (natural disasters, wars, pandemics, etc.)
- Cyber attacks or security incidents
- Your equipment or internet connection issues
- Scheduled or emergency maintenance
14Termination
Termination by You: You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will be effective at the end of the current billing period.
Termination by Us: We may suspend or terminate your access to the Services immediately, without notice, for:
- Violation of these Terms
- Non-payment of fees
- Fraudulent or illegal activity
- Abuse of the Services or harm to other users
- Any reason at our sole discretion
Effect of Termination: Upon termination:
- Your access to the Services will cease immediately
- You will no longer be charged subscription fees
- We may delete your account data after a reasonable period (typically 30 days)
- You may request a data export before termination
- Sections of these Terms that should survive termination will remain in effect
15Governing Law & Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Dispute Resolution:
- Informal Resolution: Before filing a claim, you agree to contact us at info@infinityproai.com to attempt to resolve the dispute informally
- Arbitration: Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules
- Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions
- Jurisdiction: Any legal action must be brought in the state or federal courts located in Delaware
16Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will:

- Notify you via email or through the Services
- Provide at least 30 days' notice for material changes
